Draft amendment of Article 22 of the National Sports Act passed on a third reading Civil servants can now provide commercial endorsement, taking athlete care to a higher level

Taking into account the limited length of the sports career of outstanding athletes, to care for outstanding athletes and allow outstanding athletes who are civil servants to provide commercial endorsements just like athletes of private enterprises, with the support of all party caucuses. The amendment of Article 22 of the National Sports Act was passed by the Legislative Yuan on a third reading on December 28, 2021 . Athletes who are civil servants will no longer be subject to the restrictions on commercial endorsement of the Civil Servant Work Act, taking athlete care to a higher level.

The key points of the amendments and incidental resolution are explained below:

1.Allowing athletes to give commercial endorsement: Paragraph 3 of Article 22 the central authorities shall give counsel in employment to the athletes and disabled athletes who participate in international sports competitions and achieve excellent results. The qualifications, measures, duration, application and examination procedures, counseling methods and other related matters shall be set by the central authorities was added.

2.Incidental resolution: The requirement that the Ministry of Education should amend the restrictions on part-time work or commercial endorsements by public school teachers or full-time sports coaches who previously represented the national team within six months of this amendment was added. When determination of civil servant part-time work and common explanation of related regulations are involved, the competent authority of the Civil Servant Work Act will carry out determination and handling.

With the passing of this amendment, outstanding athletes who did well at the 2020 Tokyo Olympics or who do well in various international competitions in future and who are civil servants will now be able to accept commercial endorsement, expressing the government’s intention to care for outstanding athletes and upgrading the government’s policy of caring for athletes. It is hoped more outstanding athletes will thus engage in competitive sports training, achieve good results and build a high-quality life.
